The Texas State General Assembly is rather unique among the States. It only meets in regular session once every two years and the Constitution “limits the regular session to 140 calendar days” for that one regular session. The Lieutenant Governor, who is Dan Patrick, presides over the Senate and literally controls the legislative process in the Senate. The State Senate only has 31 members for the entire State. The State House of Representatives has 150 members in comparison. It’s Congressional Districts have less population in them than does each of the State Senate Districts since there are 36 Congressional Districts compared to the 31 State Senate Districts. The Lieutenant Governor in Texas is elected independently of the Governor. Since he controls the legislative process in the Senate, many consider him the single most powerful State-wide elected official. Even more powerful than the Governor.

“Texas Privacy Act Filed on Thursday
On Thursday, Senator Lois Kolkhorst, (R-Brenham) filed one of our priority pieces of legislation, Senate Bill 6 [The lower the number the more important the bill is considered to be. All is controlled by the Lieutenant Governor. Earlier, he sent a list of the top 25 priority items for this year’s legislative session. This bill was on that list.], the Texas Privacy Act. This bill does three things:
¨ It codifies what has long been common practice in Texas and everywhere else—that men and women should use separate, designated bathrooms. We will not allow local ordinances to create laws that will make it easier for sexual predators to enter restrooms and victimize women—or anyone [Remember, that in 2014-2015 the term limited, homosexual mayor of Houston (Houston elected a new mayor in 2016.) forced through a transsexual “bathroom” bill that allowed individuals who identified as transsexual to use the bathroom of their choice in both government facilities and private facilities and businesses in Houston. The voters in Houston rebelled, forced the issue on the ballot by referendum petition, and soundly rejected the newly passed Houston local ordinance. This bill is designed to prevent local governments from doing the same in the future. It should not be needed. However, we have a lot of evil in government at the moment from local governments straight through to the federal government.].
¨ It protects free enterprise by ensuring that businesses have the freedom to determine their own bathroom policies for their business and cannot be deprived of that right by local governments who want to institute a policy for their bathrooms that they don’t want. [It gives private businesses power to make their own policy which all businesses should have anyway in a free enterprise system. Governments at all levels should not regulation business unnecessarily in a free enterprise system.].
¨ It ensures that no public school can institute a bathroom policy that allows boys to go into girls’ restrooms, locker rooms or showers and girls to go in boys’ restrooms, locker rooms or showers. [Pay attention Morton, Illinois School Board. NO school board should allow a mixing of the sexes in these circumstances. To do so is both evil and a violation of the rights of minors under your control and the rights of parents to have their child protected by requiring all students to use the proper facilities for their sex.].
An overwhelming majority of Texans including both Democrats and Republicans, Hispanics, African-Americans and Anglos, men and women support this legislation. I’m committed to fighting for this issue in order to protect public safety, the freedom of businesses and common sense.”

The Texas Privacy Act provides a civil remedy for parents when their child comes home—as they have in Texas—and tells their parents that there was a child of the opposite sex in the school bathroom. To protect children, particularly teenagers, schools will be required to designate bathrooms for boys only and girls only. Schools will be able to continue to accommodate those students who don’t want to go to the boys or girls bathroom by providing a single bathroom for them—just as they have always done.
This issue is not about discrimination—it’s about public safety, particularly for teenagers and children in public schools and protecting businesses. The Texas Privacy Act is also about common sense and common decency. I congratulate Senator Kolkhorst for filing the Texas Privacy Act and for her commitment to protecting the privacy of Texans and keeping them safe.
