A pro-life measure proposed for the November ballot in Ohio will not appear before voters because it failed to receive enough signatures to qualify.

Three Ohio citizens submitted a proposed state ballot measure to the attorney general’s office that would change their state constitution to protect unborn babies from abortions. The constitutional amendment project is led by three individuals: Laura Burton from Cleveland, Anthony Dipane from Monroe Falls and Dustin Paulson from Strasburg [If State governments wont do it, it is up to citizens to act. They have the right idea but obviously lack experience. Time to learn from their mistakes.].

They are proposing a ballot measure that would amend the state constitution to ‘prohibit abortion of all unborn human beings, without exception, and classifying it as aggravated murder in the state of Ohio.’ It also would recognize an unborn baby as ‘an individual organism … from fertilization [conception], whether fertilization occurs inside or outside of a human, until live birth.’ The measure also would make abortion a crime of ‘aggravated murder’ with jail time of up to 15 years for those found guilty [It is a two petition process. 1,000 valid signatures for the approval of the amendment language and then the required number of signatures to get it on the ballot. Or, so it seems. This is the second article about this and both are somewhat unclear on the process.]. However, some of the signatures were not valid.

‘The petition submitted to DeWine on September 2 included 1,006 signatures, but only 842 were found to be valid signatures of registered Ohio voters [This is a problem with people not familiar with the process of gathering signatures. You always want at least 25% more signatures than required. I also would have a registered voters list. I would check off the valid signatures on a copy of the petition and keep a running total of my valid signatures. That way, I knew that I had enough valid signatures and then still collected more than the minimum just to be sure.]. The law requires 1,000 signatures for a constitutional issue to proceed.

DiPane told The Dispatch that the group will submit a new batch of signatures. ‘‘Quit’ is not in our vocabulary,’ he said.

The ballot language classifies an ‘unborn human’ as being ‘an individual organism … from fertilization, whether fertilization occurs inside or outside of a human, until live birth.’

A violation would be punishable by a sentence of 15 years to life in prison.

The next step for the ballot issue would have been submission to the Secretary of State Jon Husted to place before the Ballot Board. Now, if the backers choose to try again [It reads as if they intent to try again. I hope they do!], they will have to collect a minimum of 1,000 signatures. They then would have to collect 305,591 signatures to place the issue on the ballot, probably in November 2017.’

A number of other states, including Alabama and Oklahoma also have considered similar measures to ban abortion altogether. However, these measures are highly unlikely to become law [We have allowed the federal courts to have authority that is NOT given to them by the Constitution!]. Because of the current political climate and the precedents set in the U.S. Supreme Court case Roe v. Wade, courts would almost certainly strike down the measures [It would be unconstitutional to do so! Nowhere does the Constitution give the federal courts control over State laws and State Constitutions that uphold the US Constitution!]. In 2012, the Oklahoma Supreme Court struck down a similar personhood bill as unconstitutional.

The key to ending legalized abortion is overturning Roe v. Wade [WRONG! Very, very wrong. The key is for Congress to do its constitutional duty and hold the federal courts responsible and accountable!], and the current Supreme Court justices are highly unlikely to do so, especially after the unexpected death of pro-life Justice Antonin Scalia. Three of the justices, Clarence Thomas, Samuel Alito and John Roberts, likely would vote to overturn Roe and return abortion laws back to the authority of the states [Abortion lawssanctioning the murder of unborn babiesshould not exist at the State or federal level. The Constitution protects the life of every person within the United States INCLUDING unborn babies!]; but five of the other justices almost certainly would not. Scalia’s seat on the high court remains empty.

To overturn Roe and make abortion illegal again, Americans need to elect a pro-life president and U.S. Senators who will put pro-life judges on the high court. This would pave the way for the reversal of Roe and a return to a country that protects every human life.”

NOT TRUE! The Constitution already protects ALL human lifeborn and unbornthrough Amendments V and XIV. There is no question about it. Pro-lifers need to change their approach and their reliance on unconstitutional rhetoric. The Amendments:

Amendment V

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.”

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws].

The U.S. Supreme Court acknowledged that the Constitution protects life in Roe vs. Wade. In both Roe vs. Wade (1973) and Doe vs. Bolton (1973), the Court then proceeded to immorally and unconstitutionally give government sanction to the murder of unborn babies. That government sanction to an immoral, unconstitutional action has resulted in the illegal murder of an estimated 55 million or more unborn babies. These two immoral, unconstitutional decisions, as well as others in following years, have resulted in an American holocaust. These immoral, unconstitutional court decisions are now and have always been null and void.

Abortion/murder was not, is not, and can not be the law of the land until and unless the Constitution is amended as provided in the Constitution itself. Unconstitutional court decisions are not the law of the land and are null and void.

Every abortion/murder is a criminal act and a direct assault upon the childs constitutionally protected right to life.

Government sanctioned murder is not due process of law.

The constitutional solution to government sanctioned murder:

Congress nullifies the court decisions by law:

First, define life stating that life begins at conception as it does.

Then, state clearly and emphatically in law that the federal court decisions sanctioning the murder of unborn babies are null and void since they violate the Fifth Amendment and Fourteenth Amendment.

Finally, federal court decisions are not the supreme law of the land. Laws passed by Congress pursuant to the Constitution are the supreme law of the land and supersede any and all federal court decisions. [Article 6, 2]
