Open and equal access to the ballot is the political rights issue of 21st Century America. Without all political ideologies having a place in the free marketplace of ideas, on an equal footing with the top two in power, life is like an ice cream shop that only serves two flavorscustomers grow weary and no longer buy. America flourishes when its citizens have real choices with which they identify philosophically. America’s representative system of constitutional governance is doomed to fail if voters continue to be offered only vanilla and chocolate when what they really want is mint chocolate chip or a hot fudge sundae.”

That is, if the nation really wants a flourishing republic, the political process should be opened to MORE competition not less. Competition makes everyone better and more importantly makes the outcomes better. Competition is the key in the economic world, in the sports world, and in the political world. Isn’t it strange that the Democrat Party that always talks about choices and the Republican Party that claims to value competition both work to restrict political competition? On second thought, no it is not strange. Both are trying to protect their own power by restricting access to those who might be a threat to that power. Both are more concerned about their own welfare than the welfare of the nation.

WHAT IS BALLOT ACCESS?

Ballot access is the process by which candidates are allowed to place their name on the ballot, according to the rules of their state.

WHO IS IN CHARGE OF BALLOT ACCESS?

Ballot access is defined by each state legislature. The rules and regulations are put into place by each state’s Secretary of State, then filtered down to the county, parish, or borough auditors, who run and monitor each election in their respective jurisdictions.

IS BALLOT ACCESS EQUAL FOR ALL POLITICAL PARTIES?

No. Ballot access is generally free and open to all candidates running as Republicans and Democrats. Alternative parties and independents have other steps they must follow which vary from state to state. These steps are often expensive, time-consuming, and convoluted.”

OFFICE: U.S. REPRESENTATIVE IN CONGRESS

MINIMUM AGE: 25 years (United States Constitution, Article 1, Section 2)

RESIDENCY: United States citizen for seven years. Inhabitant of Illinois at the time of the election and a registered voter. [Unconstitutional for individuals running for Congress. The U.S. Constitution only gives three requirements for a member of Congress. Being a registered voteris not one of them. The State of Illinois can not add a requirement not required by the Constitution!] (U.S. Constitution, Article I, Section 2; 10 ILCS 7-10, 10-5)

SIGNATURE ESTABLISHED PARTY CANDIDATES

REQUIREMENTS: Not less than .5% (.005) of the qualified primary electors of his/her party in the congressional district at the last presidential election. [10 ILCS 5/7-10, 10(b)]. (See Signature Requirements Section) [Also unconstitutional. The Constitution does not require nominating petitions to be a member of Congress. The State of Illinois can not add a requirement not required by the Constitution!]

INDEPENDENT CANDIDATES

Not less than 5% nor more than 8% (or 50 more than the minimum, whichever is greater) of the total number of persons who voted at the next preceding regular General Election within the congressional district. [10 ILCS 5/10-3]. (See Signature Requirements Section.)

NEW PARTY CANDIDATES

Not less than 5% of the total number of persons who voted at the next preceding regular General Election within the congressional district. There is no maximum signature requirement. [10 ILCS 5/10-2]. (See Signature Requirements Section.)

4) A candidate for whom a nomination paper has been filed as a partisan candidate at a primary election, and who is defeated for nomination, is prohibited from being listed on the ballot as an independent candidate or as a candidate of another political party and may not file a Declaration of Intent to be a Write-In candidate at that General Election. [10 ILCS 5/7-61, 10-3, 17-16.1 and 18-9.1]

2016 SIGNATURE REQUIREMENTS

U. S. CONGRESS [House of Representatives] valid signatures on nominating petition to get on the ballot for the State of Illinois. The number varies by Congressional District and by Party.

Since the Constitution Party is considered a new Party (has not been on the ballot) I had to gather at least 12,603 valid signatures. The incumbent Republican Congressman had to only gather 1,014 valid signatures and the challenging Democrat candidate had to gather only 626 valid signatures. The system is designed specifically to keep new parties and independents off of the ballot! The system is designed specifically to limit political competition and to give a monopoly to the two major political parties.
